Final operator legal name, registered address, and support email must be confirmed before public launch. These terms are provided for PaintMuse product and App Store readiness and should be reviewed by counsel.
1. PaintMuse Is A Creator Tool
PaintMuse provides tools for private creative workflow, including source asset management, AI-assisted result generation, ResultSets, exports, and credit-based technical services.
PaintMuse is not a copyright registration service, rights clearance service, licensing marketplace, legal advisor, or guarantee that any input or output is original, exclusive, non-infringing, copyrightable, registerable, commercially usable, or suitable for any particular purpose.
2. Accounts
PaintMuse V1 requires sign-in before using Workspace, Create, Projects, Library, or Account features. Sign-in methods are Apple and Google only.
You are responsible for keeping your account secure and for all activity under your account. PaintMuse may suspend or terminate accounts that violate these Terms, create legal or security risk, abuse credits, commit payment fraud, or repeatedly infringe third-party rights.
3. User Content And Responsibility
You are responsible for all content you upload, prompt, generate, store, export, publish, sell, or otherwise use through PaintMuse.
By using PaintMuse, you represent that you have the rights, permissions, or lawful basis needed for the source images, references, prompts, and other materials you provide. You must not use PaintMuse to infringe copyright, trademark, publicity rights, privacy rights, contract restrictions, platform terms, or other third-party rights.
PaintMuse does not review, certify, or clear your content for legal use. You are responsible for any rights review, license verification, or legal advice needed before commercial use.
4. AI Outputs
PaintMuse AI outputs are provided as Study Results, Reference Outputs, or other creative reference assets for composition, lighting, color, brushwork, style exploration, project planning, and related painting workflow decisions. They are not provided as copyright-cleared final commercial works.
AI systems may produce unexpected, inaccurate, low-quality, similar, or legally risky outputs. AI outputs may also be similar to other user outputs, third-party works, public materials, brands, characters, likenesses, protected designs, or other rights-sensitive material.
You retain any rights you lawfully own in your inputs. PaintMuse does not claim ownership of your private generated outputs. However, PaintMuse does not state, warrant, or promise that you own copyright in any AI-assisted output or that any output is original, copyrightable, registrable, exclusive, non-infringing, commercially usable, suitable for merchandise, suitable for client delivery, or free from third-party claims. The copyright status of AI-generated outputs may vary by jurisdiction.
You are responsible for determining whether your inputs, prompts, references, generated outputs, downloads, publication, sales, client delivery, and commercial uses comply with applicable law, platform policies, and third-party rights.
HD Download and Upscaled Download charges are technical service fees for processing/export functionality. They are not copyright fees, commercial license fees, exclusivity fees, rights clearance fees, or legal review fees. They do not grant copyright, exclusivity, commercial clearance, trademark rights, publicity rights, privacy rights, or any other third-party rights.
5. License You Grant To PaintMuse
You grant PaintMuse a limited, non-exclusive, worldwide license to host, store, copy, process, transform, transmit, display privately to you, create thumbnails, call AI providers, generate outputs, create ResultSets, create exports, provide support, secure the service, prevent abuse, process billing, troubleshoot errors, and handle legal, copyright, DMCA, dispute, and compliance requests.
V1 private user content is not used to train PaintMuse-owned models and is not used for public marketing or public galleries without separate consent.
6. Acceptable Use
You must comply with the Acceptable Use Policy. You must not upload, generate, export, sell, or distribute content that is unlawful, infringing, deceptive, abusive, exploitative, hateful, harassing, fraudulent, or otherwise prohibited.
7. Credits, Subscriptions, And Exports
Credits are an in-app service unit. Credits are not cash, stored value, securities, or transferable property.
Standard Export is free. HD Download costs 20 credits. Upscaled Download costs 120 credits. Repeated HD or Upscaled downloads may charge credits again. Failed downloads or exports should not charge credits; if credits are pre-frozen or pre-debited, PaintMuse will release or refund them according to service records.
Subscriptions and in-app purchases are processed through Apple App Store and StoreKit. Apple may handle payment, refund, tax, and subscription management according to Apple terms.
8. Takedown And Repeat Infringers
PaintMuse may block, remove, restrict, or preserve content in response to copyright notices, DMCA notices, counter-notices, legal requests, App Store requirements, user reports, or platform risk review.
Users associated with repeated valid takedowns or clear infringement may be marked as repeat infringers and may lose access to upload, generation, export, login, or account features.
9. Account Deletion And Retention
You may request account deletion in the app. Ordinary user-facing data may be deleted or anonymized. PaintMuse may preserve or anonymize records required for billing, fraud prevention, security, disputes, legal compliance, DMCA, account deletion proof, UserConsent, AIJob, ExportRecord, PaymentOrder, and CreditLedger.
10. Disclaimers
PaintMuse is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, PaintMuse disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, accuracy, output quality, and legal suitability.
11. Limitation Of Liability
To the fullest extent permitted by law, PaintMuse and its operator, developers, service providers, and affiliates are not liable for indirect, incidental, consequential, special, exemplary, punitive, lost profit, lost revenue, lost data, business interruption, reputational, or legal clearance damages.
12. Indemnity
You agree to defend, indemnify, and hold harmless PaintMuse, its operator, developers, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your content, prompts, outputs, exports, commercial use, account activity, breach of these Terms, or violation of third-party rights.
13. Changes
PaintMuse may update these Terms. Material updates may require renewed consent before continued use.
